These terms set out what we deliver, when you pay and what applies in special cases. They are deliberately written so that they can be understood without a lawyer. If in doubt, give us a call: +41 79 577 97 75.
On the German website we address you informally. These legal terms use the formal form because they are a contract.
These terms apply to all contracts between Immotion Group AG, 3600 Thun, and its clients for property media: photography, film, drone photography, virtual tours, floor plans, virtual staging and home staging. Clients may be estate agents, property management companies, developers and private individuals.
Terms of the client that deviate from these apply only if we have agreed to them in writing. A mere reference to the client’s own purchasing terms — for example on an order or in an email signature — is not sufficient.
The version published on this page at the time of the order applies. For jobs already placed, the version in force at that time continues to apply.
The presentation of our services and prices on this website is an invitation to order, not a binding offer. By completing the order — in the client area, by email or by telephone — you make a binding offer.
The contract is formed as soon as we confirm the job. As a rule, this happens within 48 hours on working days, together with the appointment confirmation. An automatic acknowledgement of receipt from the system does not yet constitute acceptance.
We may decline a job without giving reasons — for example if we lack capacity, if invoices from earlier jobs are outstanding or if the property lies outside our service area. In that case we refund any payments already made in full.
To handle your jobs, we provide you with a personal client area. There you can see the status of your jobs, download media, report sales and ask questions.
You are responsible for your login details. Keep them secret and do not pass them on. Anything that happens under your account is deemed to have been initiated by you. If you suspect misuse, notify us without delay; until you do, you bear the risk.
Invited users. You can invite staff to your organisation and assign them roles. Orders, appointment confirmations and sale reports made by these persons bind you as if they were your own acts. If someone leaves, revoke their access yourself in the client area — otherwise we will not know about it.
Availability. We endeavour to keep the client area available at all times, but we do not guarantee any particular level of availability. Maintenance work, outages at the hosting provider and internet failures may temporarily prevent access. Such interruptions do not entitle you to a price reduction or to damages and do not extend payment deadlines.
Conversely: if the client area is unavailable, deadlines that you can only meet there are extended — for example the notice of defects under clause 11 — by the duration of the outage. We can suspend our deadlines; you have the same right.
The client area is a working tool, not an archive. Keep your own copy of delivered media as well; see clause 12.
We arrange the shoot appointment in one of the three ways you choose when ordering: preferred date, date suggested by us, or direct arrangement between our photographer and the person on site. The appointment is binding as soon as it appears as confirmed in the client area.
Shoot appointments take place Monday to Friday. If a property absolutely requires a Saturday appointment — for example because the tenants work during the week — get in touch; we will then look for a solution but cannot guarantee one.
Before the appointment we give you the name and contact details of the assigned photographer, so that you have someone to call on the day of the shoot. This information is intended for handling the job concerned.
You can reschedule the appointment at any time free of charge. We only ask you to let us know as early as possible — the later you do, the harder it is to fill the photographer’s day otherwise.
You can cancel free of charge up to the start of the shoot — with one click in the client area or by telephone. Once the shoot has taken place, cancellation is no longer possible; clauses 10 and 13 apply.
If a short-notice cancellation causes us demonstrable costs — for example a third-party service already booked — we may invoice them. We tell you the amount in advance. We do not charge a flat cancellation fee.
You ensure that our team can access the property at the agreed time and that it is ready to be photographed. Ready means in particular:
Waiting time. If nobody turns up to unlock, our team waits 20 minutes from the agreed time and tries to reach the named contact person during that time. After that, it may abandon the shoot.
Wasted trip. If the shoot cannot take place for reasons not attributable to us — nobody opens the door, the property is not ready to be photographed, access is refused, the keys do not fit — we arrange a new appointment. It is treated as a new shoot appointment. The second trip is chargeable; we tell you the amount in advance and invoice it only by agreement.
Partially feasible. If only part of the services ordered can be shot, we carry out that part and deliver it. It is deemed rendered and is payable. We discuss with you how to proceed with the missing part; a second trip for it is chargeable.
Whether a property is ready to be photographed is assessed by our team on site at its professional discretion. Where possible, it will contact you or the contact person before abandoning the shoot.
All prices are in Swiss francs plus VAT, currently at 8.1%. If the statutory rate changes, the rate applicable at the time of invoicing applies.
Wherever we state prices, we indicate whether VAT is included: all prices on the website — price calculator, packages page, home page and service pages — are amounts excl. VAT so that the services can be compared. In the summary of the ordering process and on the invoice, the amounts excl. VAT and incl. VAT are shown side by side — the amount incl. VAT is what you pay.
The final price is based on the services selected and the living space of the property, using a system of seven size bands: under 60 m², 60–99, 100–139, 140–199, 200–259, 260–329 and 330 m² or more. The price table for each service is published on the packages page.
The actual floor area applies. You state it when ordering. If it turns out on site that the property falls into a higher band, we charge according to the actual area and inform you of the difference before invoicing. If the area deviates by more than one band, we may instead re-quote the job.
Travel within Switzerland is included in the price. Chargeable extras — currently only the collection and return of keys at CHF 100 — are shown individually in the ordering process and are never preselected. They are invoiced together with the media invoice (section 13).
Services you request in addition after confirmation are charged at the prices applicable at that time. We do not change prices for jobs already confirmed.
The free first job is an introductory offer for clients who market properties regularly — estate agencies, property management companies, developers and comparable commercial clients. There is no entitlement to it. Immotion Group AG decides before the job is placed whether to grant the offer and confirms this in writing. Without this confirmation, the standard terms under clause 13 apply.
If the offer is granted, it applies once per client for one property. What counts is the company, not the individual person or the individual property. Affiliated companies, branches and successor companies are treated as the same client. Photography, the Showcase, the virtual tour, floor plans and all virtual services including virtual staging are free of charge. Not included are the full-length brand film and staging in real rooms — home staging and on-site styling. If you select such services as well, only these are invoiced; the amount is shown in advance.
There is no obligation to accept or to place further jobs. The rights of use under clause 14 apply unchanged to the first job. Where a free first job has been granted, clause 13 does not apply — no payment obligation arises, either on a sale or on expiry of the twelve-month period. A second trip under clause 5 remains chargeable here too: even a free shoot involves travel.
If it turns out that the conditions were not met — for example because incorrect information was given about the commercial activity — we may subsequently invoice the service at the standard prices.
We deliver a professionally produced, edited selection. For an average residential property, the following apply as guide values:
These figures are a guide, not a warranted characteristic. What a property can offer is determined by the property: a one-and-a-half-room studio yields fewer meaningful interior views than a detached house, and a plot in a no-fly zone yields no drone shots. Selection, number, cropping and visual style are at our professional discretion. We would rather deliver ten good images than thirty mediocre ones.
There is nevertheless a lower limit. If, for a service ordered, we deliver less than half of the guide value without a reason under the preceding paragraph, you may reduce the price of that service or waive it. This is not a formality: you should be able to rely on a figure, even though we do not guarantee it down to the individual image.
We carry out drone photography only within the legally permitted framework. If a flight at the property is not permitted or the authorisation is not granted, this service lapses; we do not charge for it and offer an alternative where possible.
No entitlement to raw data. Unedited shots, raw files, project and editing files are not part of the contract and will not be handed over. Only the edited final media are owed.
Virtual staging, virtual renovation, removal of distracting objects, sky replacement and similar edits change the depiction, not the property. They show a possible condition, not the actual one.
We recommend labelling such images in the listing as virtually edited. This builds trust and prevents misunderstandings at viewings. On delivery we mark the files concerned as virtually edited and, on request, also supply the unedited counterpart.
You are responsible for the content of your listings — including ensuring that they do not mislead potential buyers. If claims are made against us arising from the use of virtually edited images, you indemnify us against third-party claims, including the costs of appropriate legal representation.
Unbooked extras. We occasionally include virtual edits unasked — notably on a first job or for properties whose condition an unedited shot alone does not convey. Everything above applies to them, with two additions: the unedited shot remains the main file and is delivered in every case, and the extra is marked as virtually edited in the delivery. You are not obliged to use it; if you do, the above applies equally. In the ordering process you can exclude extras — we then deliver only what has been booked.
We make the edited media available in the client area within 72 hours of the shoot, in web and print quality. If the shoot extends over several days, the period runs from the last day of shooting.
The period is suspended for as long as we are waiting for input from you that we need for editing — for example a missing floor plan template, an outstanding decision on furnishing or an open query. It is also suspended for as long as force majeure under clause 17 applies.
We notify you by email as soon as the delivery is ready. The day of this release is deemed the day of delivery; it marks the start of the periods under clauses 11, 12 and 13.
In the case of a partial delivery — for example because part could not be shot under clause 5 — the period for notifying defects runs for each part from its release. The retrieval period and the twelve-month period, by contrast, start uniformly with the first release; they do not restart with a subsequent delivery.
Check the delivery on receipt. Report obvious defects within 10 days of delivery in the client area or in writing, stating which file is affected and how. After this period, the delivery is deemed approved.
If a defect is justified, we rectify it — free of charge and within a reasonable time. If rectification fails at the second attempt as well, you may reduce the price of the service concerned or waive it.
Requests regarding image selection and retouching within the usual scope are included once. Further rounds, subsequent changes of creative direction and work beyond the scope ordered are charged on a time-and-effort basis; we tell you the amount in advance.
The following are not defects: differences of creative opinion, the absence of subjects the property does not offer, colour deviations caused by uncalibrated screens, and losses of quality attributable to the condition of the property within the meaning of clause 5.
Delivered media remain available in the client area for 24 months from the day of delivery. After that they are removed from it. Download your media and keep them yourself — we are not obliged to keep them permanently.
The material then remains in our archive, as a rule for up to 60 months from delivery. There is no entitlement to restoration. If the material still exists, we make it available again for a flat handling fee; we tell you the amount in advance.
If the business relationship ends or an account is closed, access to the client area ends as well. Back up your data beforehand. Statutory retention obligations — in particular the ten-year period for business records — remain unaffected.
The 3D tour is a special case. It is hosted not by us but by the tour provider, and is available for twelve months from delivery. After that it is switched off; a link in the listing then leads nowhere. On request we extend it for a surcharge — get in touch in good time, as we will not remind you of our own accord.
Further details on the processing of your data are set out in the privacy policy.
You pay nothing before the sale. No invoice is issued either on ordering or on delivery. It falls due in exactly two cases:
a) The property is sold. A sale means the conclusion of the notarised contract of sale. A reservation agreement, a verbal commitment or a letter of intent does not yet trigger the invoice.
b) The marketing period has expired. The period is twelve months from the day of delivery of the media. If the property has not been sold by then, the services rendered fall due — regardless of marketing success.
Who reports. You report the sale within 30 days of notarisation, in the client area or in writing. We determine the expiry of the twelve-month period ourselves; we inform you by email 30 days beforehand and issue the invoice no earlier than the day after the period ends. You may also report the expiry early if you stop marketing the property.
Information. We may ask you once per quarter about the status of the marketing. You answer truthfully within 10 days.
If a transfer of ownership is apparent — for example from a publicly accessible source — and you do not reply to a written enquiry within a deadline of 14 days, we may treat the sale as having taken place and issue an invoice. You remain free to prove that no sale has taken place; we then cancel the invoice.
A listing disappearing from the portals is expressly not sufficient for this. Properties are paused, repriced and relisted with new images — inferring a sale from that would be an unfounded assumption.
Late reporting. If you do not report a sale within the deadline, the invoice falls due retroactively as of the day of notarisation; default interest runs from that date.
If the property is let instead of sold or you withdraw it from the market, this counts as ending the marketing. The services then fall due at the time marketing ends, but no later than on expiry of the twelve-month period.
If the client loses the mandate, it notifies us within 30 days. The period continues to run unchanged; on request we transfer the job to the new mandate holder, provided they take it over. Until they take it over in writing, you remain our contractual partner.
In all cases the payment term is 20 days from the invoice date. If it expires without payment, you are in default without further reminder; default interest of 5% per annum accrues, and we charge CHF 20 for each reminder. The costs of debt collection and debt enforcement proceedings are borne by you to the extent permitted by law.
As long as an invoice that has fallen due remains unpaid, we may decline new jobs and suspend work in progress. Set-off against counterclaims is permitted only if they are undisputed or have been established by a court. We may assign claims to third parties.
On delivery you receive a non-exclusive right of use, unlimited in territory and time, to all delivered media for marketing the property concerned: listings, portals, your own website, print, social media and sales documentation. This right arises immediately, regardless of whether the invoice has already been paid — you should be able to use the images before you pay for them.
Copyright remains with Immotion Group AG. Passing the media on to third parties for their own use and selling the media are not permitted. Use by the owners of the property and by commissioned portals is included.
What is not permitted: use for another property, use as part of an image database or a resale offering, and any editing that distorts the character of the shot. Cropping, format adjustments and adding your logo for listings are expressly permitted.
Our own portfolio. We like to show shots in our references. You can object to this at any time without formality — when ordering, in the client area or by email. For discreet mandates, the objection is deemed given as soon as you inform us of the confidentiality. Without your express consent we name neither the address nor the owners.
If you pass on to us the names and contact details of the owners or tenants, you warrant that you are entitled to do so and that you have informed these persons of the disclosure. We use this data exclusively for carrying out the shoot. Details are set out in the privacy policy.
If people are recognisable in the shots or other people’s land is shown to a significant extent, you obtain the necessary consents. We carry out drone flights only within the legally permitted framework; we obtain the necessary permits.
You warrant that you are entitled to place the job — as the owner, as the commissioned estate agency or with their consent. If you lack this entitlement, you indemnify us against any resulting third-party claims.
We may use documents you give us — floor plans, drawings, texts, logos — to perform the job. You warrant that you are entitled to provide them.
We are liable for performing our services in accordance with the contract. Liability is limited in amount to the value of the job concerned. We are not liable for loss of profit, sales that fail to materialise or are delayed, marketing risks or indirect damage. These limitations do not apply in cases of intent or gross negligence, nor to personal injury.
We do not owe any marketing success. Whether and at what price a property sells depends on factors beyond our control.
We are liable for loss of data only within the scope of clause 12 and only to the extent that you have met your own duty to keep backups. Clause 3 applies to outages of the client area.
We are liable for auxiliary persons as for our own conduct. Claims under this contract must be asserted within twelve months of becoming aware of the damage, unless the law mandatorily provides for a longer period.
In the event of storms, heavy rain, snowfall or other circumstances that make high-quality shots impossible, we reschedule the appointment. This costs you nothing — including no second trip under clause 5, since you are not responsible for the cancellation. In this case the twelve-month period starts only with the actual delivery.
Force majeure also includes illness and accidents affecting our staff, orders by public authorities, network and power outages and failures of our technical service providers. For as long as such an event lasts, our deadlines are suspended. If it lasts longer than 30 days, either party may terminate the job concerned without cost; partial services already rendered are invoiced.
Amendments and additions must be made in text form. Email and messages in the client area are sufficient. Should any provision be invalid, the remainder of the contract remains valid; it is replaced by the permissible provision that comes closest to what was intended.
Notices are deemed delivered when they have been sent to the email address stored in the client area. Keep it up to date.
You may transfer rights and obligations under this contract only with our written consent. We may transfer the contract in the course of a business succession.
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
